LAM HOA CHO NGUOI TA HAI (A FLOWER TO BE PICKED)

OBJECTIVE  

This project is aimed to raise awareness for workers in the factory on the subject of Sexual Harassment. Our ATH team has been helping raise awareness in different factories throughout Vietnam.  

WHAT IS SEXUAL HARASSMENT?  

The EEOC has defined sexual harassment in its guidelines as:  

Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when:  

· Submission to such conduct is made either explicitly or implicitly a term or condition of an individual's employment, or  

· Submission to or rejection of such conduct by an individual is used as a basis for employment decisions affecting such individual, or  

· Such conduct has the purpose or effect of unreasonably interfering with an individual's work performance or creating an intimidating, hostile, or offensive work environment.  

Unwelcome Behavior is the critical word. Unwelcome does not mean "involuntary." A victim may consent or agree to certain conduct and actively participate in it even though it is offensive and objectionable. Therefore, sexual conduct is unwelcomed whenever the person subjected to it considers it unwelcome. Whether the person in fact welcomed a request for a date, sex-oriented comment, or joke depends on all the circumstances.

SITUATION IN VIETNAM 

About the legislation: 

Researches on Sexual Harassment are conducted in Vietnam from the 90s.  

Until 2019, in the Law of Labor, the term « Sexual harrassment » is mentioned. The Ministry of Labour and the Federation of labour released a kit of prevention for companies and factories, but it's not mandatory to follow the kit. They only encourage factories to diffuse it to workers.   

In 2019, the International Labor Organization (ILO) released the C190 Convention, which is the first international treaty that « recognizes the right of everyone to a world of work free from violence and harassment, including gender-based violence and harassment”.  

We are still waiting for the Vietnamese government to validate this convention in Vietnam.  

About people awareness: 

  • Before, the words “sexual relationship” and “make love” were forbidden by the law in school. Now, the ministry of Education validated the subject “Sexual education” which is officially taught at school from middle school.  

  • Before, people were embarrassed to say the words “sexual”, or to admit they made love. Now, through their last project with students from Thai Nguyen university, students are at ease saying these words or even talking about their sexual relationships.  

  • Vietnamese people understand now that the law can protect them from sexual harassment, and that society will protect them by condemning the harasser. 

However, they don't (or barely) understand that they can and have tools to protect themselves  

HOW DO WE PROCEED?  

The project comprises 4 phases  

  1. Research  

Our research team collected information through past research by NGOs. They contacted the factories to ask about the actual situation in the factory. 

In this project, we collaborated with the following NGOs : CARE VIETNAM, CGFED, HAGAR VIETNAM, CSAGA

  1. Creation 

Our team comprises 4 members, 3 artists, and 1 director in the performing arts field.  

The script is based on the research’s results, aiming to create a realistic situation in the factory. The story tells about the relationship between workers in the factory and reveals their culture and point of view by using specific vocabulary and cultural references. To clarify the notion of sexual harassment, the play happens in different significant spaces in the factory and the act of harassment endures through time and takes different forms.  

Only three actors on stage manipulate 3 boxes, which help indicate the change of scenery. Two lights and one speaker, actually contained in the 3 boxes, complete the set. This minimal set is adapted to every space that we may have.  

  1. Implementation 

An important early phase includes 3 key performances with 3 different audiences: the managers; the workers; and the local community, to fully understand the situation in their workplace and in their living zones, to then adapt our performance. Another objective was also to find the real issue that the targeted audience encounter (in this case, the workers).  

This version will be implemented in all the selected factories. Our report after each session will help to adapt the performance.  

  1. Refresh 

After performances at the factories, where they could find themselves in hypothetical solutions regarding these issues, we were able to go back to their factories to organize a workshop, where they were not the audience but active participants. Through games and role-playing we could renew their knowledge and create a next step in their action plan.
